Acceptance of Terms

By accessing or using NovaESL's services, website, or materials, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Service Description and Scope

NovaESL provides online educational services focused on preparation for language proficiency exams including IELTS, CELPIP, TEF, and TCF. Our services include:

  • Online instruction and study materials
  • Practice exercises and mock tests
  • Feedback on student work
  • Access to learning resources and platforms

Important: NovaESL is an independent test preparation service. We are not affiliated with, endorsed by, or officially connected to the organizations that administer IELTS, CELPIP, TEF, or TCF exams. We do not guarantee specific exam scores or results.

No Score Guarantees

NovaESL provides educational preparation services designed to help students improve their language skills. However, we make no guarantees, warranties, or representations regarding:

  • Specific exam scores or results
  • Passing grades or minimum score achievement
  • Acceptance into academic programs or immigration applications
  • Individual improvement rates or learning outcomes

Student success depends on many factors including individual effort, prior knowledge, and exam performance on test day.

Enrollment and Payment

When you enroll in our services, you agree to:

  • Provide accurate and complete registration information
  • Pay all applicable fees according to the payment schedule
  • Maintain the confidentiality of your account credentials
  • Notify us promptly of any unauthorized use of your account

All fees are in Canadian dollars (CAD) unless otherwise specified. Payment is due at the time of enrollment unless alternative arrangements have been made in writing.

Refund Policy

We offer a 7-day satisfaction guarantee from your enrollment date. If you request a refund within this period, we will provide a full refund of tuition paid.

After the 7-day period, refunds will be calculated on a prorated basis:

  • Refunds are based on unused course time remaining
  • An administrative fee of 15% or $100 CAD (whichever is less) will be deducted
  • No refunds are provided for courses more than 75% completed
  • Refund requests must be submitted in writing

Intellectual Property

All course materials, content, and resources provided by NovaESL are protected by copyright and other intellectual property laws. You may:

  • Use materials for personal study purposes only
  • Download or print materials for your own use

You may not:

  • Share, distribute, or sell course materials to others
  • Copy or reproduce materials for commercial purposes
  • Modify or create derivative works from our content

Student Conduct

Students are expected to:

  • Treat instructors and fellow students with respect
  • Attend scheduled sessions or notify us of absences
  • Complete assignments and practice exercises in good faith
  • Refrain from disruptive or inappropriate behavior

We reserve the right to terminate enrollment for violations of these conduct standards without refund.

Certificates and Credentials

Upon completion of our program, students may receive a certificate of completion. This certificate:

  • Acknowledges participation in our preparation course
  • Is a non-academic certificate with no official accreditation
  • Does not constitute academic credit or professional certification
  • Is not affiliated with or recognized by official exam administrators

Limitation of Liability

To the maximum extent permitted by law, NovaESL and its instructors shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of income, opportunities, or educational outcomes
  • Technical issues, service interruptions, or platform downtime
  • Damages exceeding the amount paid for services

Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice of significant changes that affect enrolled students.

Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Montreal, Quebec.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
